Terms of Service

These Terms govern your use of the RestaurantGPT platform. Please read them carefully — if anything is unclear, contact us before signing up.

1. Acceptance of terms

By creating an account or using the RestaurantGPT platform, you agree to these Terms. If you don't agree, don't use the service. If you're using the service on behalf of a business, you represent that you have the authority to bind that business.

2. The service

RestaurantGPT provides software tools for independent restaurants — including instant websites, online ordering, a 24/7 phone receptionist, and automated marketing. The exact features available to your account depend on your plan.

3. Your account

You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Notify us immediately at hello@restaurantgpt.xyz if you suspect unauthorized access.

4. Acceptable use

You agree not to use the service to: violate any law or regulation; infringe any third party's rights; transmit malware; attempt to disrupt or reverse-engineer the platform; or send spam through the marketing tools.

5. Payments

Subscription fees are billed in advance per the plan you select. Per-order processing fees are deducted automatically from payouts via Stripe Connect. Late payment may result in service suspension. You're responsible for any taxes applicable to your jurisdiction.

6. Termination

You may cancel anytime from your dashboard or by contacting us. We may suspend or terminate accounts that violate these Terms. Upon termination, you can export your data for a reasonable period before it is deleted.

7. Intellectual property

You own the content you upload (menus, photos, brand assets). You grant us a limited license to use that content to operate and improve the service. We retain ownership of the platform itself, including all software, branding, and machine-generated outputs that aren't derived from your content.

8. Disclaimers

The service is provided "as is." We don't guarantee specific business outcomes — no software tool can promise more sales. We work to keep the platform reliable, but we don't warrant uninterrupted or error-free operation.

9. Limitation of liability

To the maximum extent permitted by law, our liability for any claim arising from your use of the service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Indemnification

You agree to defend and indemnify RestaurantGPT against claims arising from your content, your use of the service, or your violation of these Terms.

11. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in San Francisco County, California.

12. Changes

We may update these Terms from time to time. Material changes will be announced via email and a notice in the dashboard. Continued use after the effective date constitutes acceptance.
